Legal Notes and General Conditions of the Contract

1. Scope and subject of the contract.
1.1. These General Terms and Conditions govern the relationship between Como Lake Studios (for all its properties) and the Customer regarding the provision of accommodation services chosen by the Customer in the booking proposal made among those offered by the Facility, viewable on the website [www.comolakestudios.com](http://www.comolakestudios.com).
1.2. The request for the provision of Services can be made by the Customer by submitting the booking proposal to Como Lake Studios by: sending an email to the email address [comolakestudios@gmail.com](mailto:comolakestudios@gmail.com); verbally by phone, contacting the number +393482802220 or +393393675443; through the online booking procedure available on the website.
1.3. The contract is considered concluded when the Customer formulates the booking proposal in the ways provided in point 1.2. and brings it to the attention of Como Lake Studios. The actual conclusion is always subject to the availability of the Service. This confirmation is provided by Como Lake Studios at the same time as the receipt of the Proposal or immediately thereafter.
1.4. If the activation of the Services cannot take place due to impediments not attributable to Como Lake Studios, the contract will automatically terminate, without this resulting in any liability of Como Lake Studios towards the Customer.

2. Activation and provision of the Service.
2.1. Upon activation of the Service, Como Lake Studios guarantees the Customer: – the enjoyment of furnished housing units (hereinafter "Studios"), in the number and type defined in the Proposal. – internet connection, weekly tidying up and linen change, and any service provided by the current regional law on "Holiday Homes".
2.2. Como Lake Studios will provide the Customer with any other accessory equipment necessary for the complete enjoyment of the chosen Services (keys, cards, etc.) on a loan-for-use basis.
2.3. The Customer must use the Rooms, common areas, and equipment in such a way as not to disturb the normal course of the Service and the third parties accommodated in the condominium structures. The Customer will be solely responsible for any direct damages resulting from the violation of this obligation, keeping Como Lake Studios harmless from any consequence, cost, or burden. 2.4. The Customer will keep Como Lake Studios harmless from any prejudice, damage, liability, expenses, including legal ones, suffered or incurred by Como Lake Studios, and will indemnify it from any action, reason, claim advanced by third parties against it that find cause or reason in behaviors and/or omissions in any way attributable to the Customer or are in any case a consequence of the non-compliance and/or violation of the provisions of these General Terms and Conditions.

3. Booking and Payment.
3.1. In the case of a future booking, Como Lake Studios requires the Customer to pay the amount due 15 days in advance of the first day of arrival and overnight stay. u
3.2. Failure to pay the amount due within the terms mentioned above will result in the cancellation of the booking, without any need for communication from Como Lake Studios.
3.3. For non-cancellable bookings, a 10% discount applies.

4. Duration of the Contract, cancellations, and penalties.
4.1. The Contract is valid and effective from the date of conclusion of the Contract itself and ends if both of the following conditions are met: – the Customer and the third parties connected to it, or dependent on it, have definitively left the housing structure of Como Lake Studios; – the Customer has paid the entire amount due to Como Lake Studios.
4.2. Check-in must be carried out between 14:00 and 17:00, it is not possible to use the entire structure before this time. Any arrivals outside the scheduled time must be agreed upon in advance with Como Lake Studios. Failure to give notice may cause long waits for which no complaints or refund claims are accepted. Check-out must strictly take place by 09:00, if this does not happen; the cost of an additional night will be charged unless otherwise agreed with the manager.
4.3. The Customer has the right to cancel the booking and terminate the contract within the time limits mentioned in points 3.1 and 3.3. No refund is provided for the guest who leaves the apartments of Como Lake Studios early, whatever the cause.

5. Privacy protection.
5.1. The Customer is informed, pursuant to Article 13 of Legislative Decree no. 196/2003, that the processing of personal data provided to Como Lake Studios is necessary to allow the Studios directly or also through third parties to fulfill the obligations arising from this contract or for the fulfillment of the obligations provided by law or regulations.
5.2. The data controller is the legal representative of Como Lake Studios.

6. Documents.
6.1. The identity documents (Passport, Identity Card) necessary for the registrations required by the current legislation must be sent before arrival via email or WhatsApp. Failure to comply with this obligation constitutes a violation of the Criminal Code and authorizes us to request the immediate abandonment of the properties of Como Lake Studios. The data of our guests are processed in accordance with the current privacy legislation.

7. Responsibility of Como Lake Studios.
 7.1. Como Lake Studios will be responsible for contractual non-performance and the provision of the Service exclusively for reasons attributable to it.
7.2. If the Customer upon arrival finds a Service different from the agreed one but accepts it anyway, they are automatically deprived of any compensation claim and the new Service replaces, by agreement of the parties, the previously agreed one.

8. Limits of responsibility.
8.1. Como Lake Studios will not be responsible in case of delays, inconveniences, malfunctions, and/or interruptions of the Service due to: – fortuitous event or force majeure; – tampering or interventions on the service or equipment carried out by the Customer or by third parties not authorized by Como Lake Studios; – damages or inconveniences caused by the total or partial interruption of the electricity or water supply; – Como Lake Studios will not be responsible for the valuable objects owned by customers and brought inside the structure.

9. The management recommends:
9.1. Silence/Children. Total silence must be observed from 23:00 to 07:00; Children must always be accompanied by an adult. In any case, behavior must be maintained that at no time of the day and in no way harms the tranquility of others.
9.2. Cleaning. In case of long stays, the apartment is tidied up weekly. The rooms must be vacated by 09:00 for cleaning. If the rooms are not vacated by 09:00, cleaning will be postponed to the next day. Please kindly arrange your personal belongings to allow such cleaning.
9.3. Other Guests. It is strictly forbidden to introduce other people into the apartments without the manager's authorization, under penalty of a supplement of € 250.00. The customer cannot sublet or lend, in whole or in part, the apartment, under penalty of the cancellation of the booking right and a penalty supplement of € 250.00.
9.4. Smoking/Weapons/Drugs. It is strictly forbidden to introduce weapons, drugs, and other substances. Under penalty of immediate contract termination. It is also strictly forbidden to smoke in any area of the building where the apartments are located.
9.5. Personal Items. Como Lake Studios is not responsible for personal items left unattended. No objects of any kind can be left in the corridors or common areas.
9.6. Animals. It is strictly forbidden to introduce animals of any kind or size into the apartments.
9.7. Sense of decency. It is strictly forbidden to wander inside the buildings wearing clothing that may offend the decency of others. The Customer is prohibited from performing acts and behaviors that may disturb the other inhabitants of the buildings.
9.8. Sanitary Services. Proper and civil use of sanitary services is recommended, avoiding throwing anything into the toilet (use the appropriate bins).
